For all the non-native’s in the Netherlands who are a ZZP (contractor) or work with ZZP (contractor).

It is not always clear what is a true ZZP and someone who is working under a labor contract. Because of this ambiguity a whole group of people who are now working as ZZP should actually be working under a labor contract, the so-called SchijnZZP.

There is no longer a moratorium on the enforcement of the split in ZZP and labor work by the tax office. That is important for you to know and to act upon.

For companies with ZZP. Having someone reclassified as a laborer has big consequences.

If your ZZP actually is a laborer, then you have to pay wage taxes, pension premiums and social security premiums. Furthermore, someone working under a labor contract has extensive rights under Dutch law. Protections against dismissal, two years of payment when they get sick etc.
